If a employee is on daily rate basis, is the unwork public holiday payable to him?

1. Hello, this is Ministry of Employment and Labor Counseling Center.


 


2. ‘Statutory holidays’ refer to holidays (for public officials) of government offices pursuant to 「Regulations on Holidays of Government Offices」.


The amendment of the Labor Standards Act (on March 20, 2018) regarding paid statutory holidays under Regulations on Holidays of Government Offices will be applied by gradation in the size of business: from January 1, 2020 in a workplace with more than 300 employees; from January 1, 2021 in a workplace with more than 30 and less than 300 employees; from January 1, 2022 in a workplace with more than 5 and less than 30 employees.


3. Therefore, it could vary in accordance with the size of a business or workplace.
